I spend a lot of time in Bisbee, Arizona, a town known for its funky temper and artsy vibe. Some local stores sell bumper stickers that sum up the town perfectly: “It’s like Mayberry on acid.” If you’re ever in southern Arizona, it’s definitely worth stopping by. One of the cool things I found recently in Bisbee is an “art vending machine”. Green Valley News describes the project, which was unveiled a few years ago and is currently located in the Bisbee Convention Center just off the front of the restaurant Bisbee table:

Looking to bring home an original by one of Bisbee’s talented and beloved local artists, but have limited funds or space? Trust the creative city to find an original solution.

The Bisbee Arts Commission recently unveiled its latest project, a vintage cigarette machine repurposed to dispense palm-sized paints, jewelry, fibers and carvings carefully inserted into yellow cigarette cartons.

The project was designed as a way to provide a steady stream of revenue to local artists and the commission, said BAC President Karen Schumacher.

“Half the money goes to us, but the other half goes to the artist,” Schumacher said.

Bisbee has some wonderful local artists, so it was super cool to see the vending machine (it’s called the “CIGART”) and be able to buy a little piece of local art. I was lucky enough to get a piece by artist and longtime Bisbee resident Ken Boe, who also hosts the very cool “Bisbee Poetry Normalization Project”, which helps put art and poetry into random places all over town.

Finding this cool project in Bisbee made me want to learn more about the practice of using old cigarette machines to distribute art and other non-cigarette items. I found an awesome article in Garden and Gun magazine titled “The Southern History of the Art-o-mat” which traces their history to Winston-Salem, NC when artist Clark Whittington created the first Art-o-mat in 1997. Garden and Gun Explain :

Cigarette machines were once found all over the country, but especially in Winston-Salem, North Carolina, home to the RJ Reynolds tobacco empire. But in the 1990s, many were decommissioned and left to rust as the risks of smoking became more apparent – that is, until a local had an idea to reuse them.

Instead of putting packets of cigarettes in a machine, artist Clark Whittington began inserting tiny works of art, into cartons of the same size – starting with his own, then expanding to many more. other artists – and dubbed it the Art-o-mat. He displayed the first machine at a solo art show at a since-closed local cafe called Pennie University, in 1997.

The article goes on to describe how, currently, Art-o-mats can be found in over 200 locations all over the United States, and now also in other countries. This official map keeps track of all machines, but doesn’t capture all similar projects that aren’t officially “Art-o-mats”, like the machine I encountered in Bisbee:

Today, Art-o-mats can be found in over two hundred locations nationwide, in art museums, hotels, bars and galleries (including the Cosmopolitan in Las Vegas, the Hunter Museum of American Art in Chattanooga and the Esquire Tavern in San Antonio) as well as on countless college campuses. A location map on the Art-o-mat website also shows one in Berlin and another in Australia.

Artists, who receive commissions on sales, apply via the website and must provide a certain number of works to meet the demand. The art objects themselves vary wildly, from a printed block to a piece of jewelry to felted creatures. There is a constant need for more art to fill the machines, which are rented out to places that buy the art.

Whether officially “Art-o-mats” or not, these machines that dispense local art are magnificent. I invite you to look at the map and see if there are any in your area, and if so, go check them out and buy some local art! And if there isn’t one near you, hop in your car and head to Bisbee, Arizona to check out his “CIGART” machine. We promise, you won’t be disappointed!

Along with the rise in murders in recent years has come another trend: criminals are increasingly modifying their firearms to allow for fully automatic fire, converting simple handguns into tiny machine guns.

Houston police brought 19 cases involving firearms fitted with these “Glock switches” earlier this year, including a shooting that injured three officers. Last year, another Houston police officer was killed while executing a warrant after the criminal pulled a Glock with a switch and opened fire. In April, six people were killed in a large gang shootout in downtown Sacramento where one of the criminals used a gun with a Glock switch, authorities said.

There are no comprehensive national statistics on the proliferation of Glock switches, but it appears that they were used in only a small fraction of violent crimes committed with firearms.

“It’s largely a novelty,” a firearms expert told The Epoch Times.

The switch allows popular Glock handguns to quickly fire bullets with the simple pull of the trigger.

Machine guns are generally illegal in the United States. The exception are those made before 1986, which have become prohibitively expensive, and those held by licensed gun dealers. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) considers Glock to be a switch gun. Obtaining one illegally can therefore land a person in federal prison for up to a decade.

In 2020, the ATF in Houston confiscated approximately 30 such switches. In 2021, the number has risen to nearly 150, local media reported.

A Glock switch is a small device about an inch in diameter. It snaps into the back of the gun and applies pressure to the trigger mechanism so it won’t stop after firing a single shot. A regular Glock can eat up a 30 round magazine in about 2.3 seconds.

Such a gun is very impractical, as the rapid recoil and small size make it difficult to control and extremely inaccurate. Because most Glocks use 9mm ammunition, the recoil is pretty strong and the muzzle will straighten more and more the longer the trigger is pulled, explained Charles Heller, firearms instructor and radio host in Arizona.

“If you’re using a fully automatic Glock, you’re going to be shooting planes pretty quickly,” he told The Epoch Times.

Such a modified weapon becomes more dangerous at close range, he said.

“If you can put three to five hits on someone instead of one or two, it’s more deadly.”

There are a small number of such switches that are legally owned by people with the required license. Some law enforcement agencies also have them, according to Heller.

Unlicensed switches started to proliferate in the last few years after some people in China started making them and selling them online. According to the ATF, they are usually sent directly to the United States or smuggled through Mexico. Some have also been made domestically on 3D printers. The agency identified about 2,500 people who may have purchased one, WGN TV reported in 2019.

An ATF spokesperson told The Epoch Times that the agency has not released any statistics on specific switches and has not been able to verify the figure reported in 2019 “based on information alone. contained in the article”. He noted, however, that “from 2017 to 2021, machine gun conversion devices recovered by the ATF grew from less than 100 to over 1,500”.

That, however, includes other devices that allow fully automatic fire, not just switches, he clarified by email.

In Heller’s opinion, Glock Switches – or machine guns, for that matter – shouldn’t be illegal in the first place, according to the Second Amendment, and since the Switches are so primitive and can be 3D printed, it won’t be Not possible. to prevent people who are willing to break the law from acquiring them, he argued.

“The genie came out of the bottle on 3D printing, you can never undo it,” he said.

Social networks “chop our minds” and produce effects that are simply infuriating. This is what New York Times journalist Max Fisher argues in his new book The Chaos Machine.

In less confident hands, this statement might read as hyperbolic and similar in tenor to the feverish tone of most online discourse. Fisher, however, is a seasoned journalist who has covered the rise of social media for many years. Unlike online “flame wars” that burn brightly but have the intellectual depth of a puddle, his analysis is well-argued, engaging, and often necessarily uncomfortable.

The Chaos MachinePerhaps its greatest achievement is the skill with which it traces seemingly disparate phenomena — Gamergate, QAnon, civil unrest in Myanmar, growing polarization in the West, thriving anti-vax Facebook groups among many examples — until ‘to designing social media platforms that prioritize engagement at all costs.

Fisher repeatedly shows Silicon Valley’s reluctance to reign over their creations or acknowledge their downsides. “Engagement” cannot be disrupted, even when it shows a distinct predilection for escalating tensions or when it spills dramatically into the offline world, as was the case in the attack on January 2021 against the US Capitol. Videos of cute cats or incitement to overthrow a democratically elected government, it’s all fair in the battle for the eyeballs that is the digital attention economy.

Fisher’s experiences as a journalist with rare access to social media executives are telling. They are, as he puts it, “dutiful and ultra-qualified people”, but they seem bewildered when asked about what looks like an elephant in the room.

“[A]At some point in every interview,” he wrote of Facebook meetings, “when I asked about the dangers that stemmed not from bad actors misusing the platform, but from the platform itself, it would be as if a mental wall were erected.

Again and again, these executives point to the role of human misbehavior on social media, but fake an essential element: how these platforms are actively designed to manipulate users’ motivations and experiences so that they click, scroll and share.

Social media companies don’t make a product in the traditional sense. They don’t manufacture hardware; instead, they create vast networks of potential consumers that can be delivered to advertisers and marketers. This conception is not fortuitous; it is at the heart of the immense wealth and power these companies enjoy.

Given this fact, there is something troubling about this reluctance to openly consider the effects and flaws of their product design. Of his visits to Facebook, Fisher writes, “It was like walking into a cigarette factory and being told by executives that they didn’t understand why people kept complaining about the health effects of the little tins. in cardboard that they were selling.

close

Max Fisher, author of The Chaos Machine. Photo by Francisco Prone

Behind closed doors, however, it would seem that Facebook is aware of the problems with its platforms. As Fisher writes, internal research conducted by the company in 2018 and disclosed to the the wall street journalfound: “Our algorithms exploit the human brain’s attraction to division.”

If the algorithms that determine what we see or don’t see on our screens every day were driven primarily by humans with monitoring responsibilities, that would be one thing. However, as Fisher points out, thanks to advances in artificial intelligence (AI), algorithms are largely left to their own devices. What exactly these devices are is something that activists, tech journalists and researchers have struggled to understand.

Video of the day

“[N]o it is well known how the algorithms that govern social media actually work,” Fisher writes. “The systems operate semi-autonomously, their methods are beyond human reach.”

Simply put, algorithms are designed to give users more of what they want. But this frankness can have negative consequences when this quest for “more” pushes users towards increasingly extreme content. Without the moderating effects of human oversight, this rabbit hole effect can contribute to marginalization and radicalization.

YouTube, run by Susan Wojcicki, is the subject of particular criticism. Of his move to an AI-driven algorithm and the surge in user engagement that followed, Fisher writes, “It was like Coca-Cola stocking a billion machines soda with an AI-designed drink without a single human checking the contents of the bottles – and whether the drink-filling AI was programmed solely to increase sales without regard to health or safety.

The Chaos Machine – subtitle The inside story of how social media has rewired our minds and our world – joins a stable of modern journalism that not only captures the evils of social media in their current form, but also offers potential solutions. At a time of growing calls for platform regulation, Fisher makes the case for urgent and compelling change.

Accurate insect identification is the first and most important step in pest control. Insect identification is essential in agriculture to choose the best management approaches.

Study: Identifying Caterpillar Egg Species by Machine Learning Using a Convolutional Neural Network and a Massively Parallelized Microscope. Image Credit: jelloyd/Shutterstock.com

Tobacco bollworm (Helicoverpa zea) and budworm (Chloridea virescens) both hatch five days after oviposition. Helicoverpa zea has developed tolerance to Bt transgenic crops, therefore farmers must apply insecticides during the egg-laying window. Helicoverpa zea eggs are tiny, measuring 0.5 mm in diameter, making it necessary to use a microscope to distinguish the different species.

A recent study published in Agriculture suggests a machine learning approach using a convolutional neural network to classify different types of caterpillars with high accuracy. The researchers created a dataset of approximately 5,500 images to quickly train and test the network using the Multi-Camera Array Microscope (MCAMTM), a gigapixel-sized parallelized microscope and an automated image processing pipeline. In the future, the software could allow farmers to take an image of eggs on a leaf and instantly identify the species before the eggs hatch.

Damage caused by uncontrolled insects

The tobacco budworm Chloridea virescens (formerly Heliothis virescens) and the bollworm Helicoverpa zea (Lepidoptera: Noctuidae) are important agricultural pests. When left unchecked, they cause most of the pest damage to cotton in the southeastern United States.

The larvae consume various agricultural products, such as cotton, corn, tobacco, soybeans, tomatoes, wheat, and vegetable garden plants. They are managed in cotton using transgenic plants that express the insecticidal Cry proteins of the bacterium Bacillus thuringiensis (Bt), together with the occasional application of chemical foliar insecticides. Unfortunately, Cry protein resistance is spreading and getting worse.

Importance of insect egg identification in pest control

Identification is the first step in managing the US tobacco bollworm-budworm complex in cotton. This allows for the adoption of the appropriate management approach for that particular insect.

The economic threshold for bollworms in cotton was based on the presence of live larvae or damaged plant reproductive tissue prior to Bt resistance in Helicoverpa zea. After Helicoverpa zea developed resistance to Bt, egg-based thresholds were adopted to decide when to spray.

Challenges in Identifying Insect Eggs

Heliothis virescens and Helicoverpa zea are identical in color, size and shape. The only difference between them is the presence of small cuticular ridges on the surface of Helicoverpa zea. Egg identification requires a high magnification brightfield microscope and a researcher with extensive experience in determining the small cuticular ridges on the surface of the egg.

When managing populations of common pests, this approach is not practical because it is necessary to collect many samples from fields spread over a large geographical area.

Development of a dataset of Heliothis Virescens and Helicoverpa Zea using machine learning methodology

Deep learning is used more in the biological sciences. Applying convolutional neural networks (CNN) to digital photographs produces repetitive image classifications. An image dataset of Heliothis virescens and Helicoverpa zea was developed by Efromson et al.

The researchers used a multi-camera microscope (MCAMTM) and, using the data from this analysis, created a machine learning methodology to quickly distinguish species.

The subtle and difficult physical changes between two species make this the perfect test case to demonstrate the usefulness and effectiveness of deep learning in identifying insect eggs. Rapid, unbiased, high throughput, reproducible analysis, low cost, and a means to improve the sustainability of insect management are all advantages of this technique.

The future of pest control using deep learning

This research aims to demonstrate the viability of egg identification through high-resolution microscopy and machine learning. A computer vision methodology would offer readily available, reproducible identification that otherwise would not be available for the short time needed to make pest control decisions. For example, one option might be to take a high-resolution photo of an insect egg with a smartphone to identify the type of insect.

The researchers found that a machine learning method had a 99.3% accuracy rate in classifying egg images of two caterpillar species. The two species studied represented the worst case situation in which only minute morphological variations exist between species. In the past, identifying these caterpillar eggs required the use of species-specific antibody assays or microscopy to examine minute morphological variations.

The suggested deep learning algorithm only required a representative high-resolution digital image of the user. It generated automated and unbiased output, unlike the labour-intensive subjective analysis required by current methods. This is the first account of an insect species being identified from eggs using deep learning techniques, which has implications for other important pest management issues.

Looking for this vending machine for a Hershey bar? The vending machine, that familiar device at gas stations and schools, gyms and offices, made its first appearance in the United States in 1888, selling chewing gum on New York train platforms. Known early on as “trade boosters”, these machines lived up to their name, and in the modern age were both ubiquitous and successful in their sales of candy bars and sodas, cigarettes and hygiene items.

No wonder Green Roads, the Florida-based CBD and wellness products company, is eager to use this sales channel for its legal products. “Vending machines as a point-of-sale experience have exploded,” Green Roads marketing director Lee Sosin said in a recent interview. “You walk through an airport terminal and see everything from beauty products to headphones; and the technology has become very sophisticated and user-friendly.

At the end of August, Green Roads launched the installation of phase 1 of the first 30 of a possible 40 machines in 37 shopping centers, all owned by the Simon Property Group. Locations range from New York and New Jersey to Florida, Illinois and as far away as Anchorage, Alaska. Sosin called these CBD vending machines a first. The machines themselves, designed by Signifi Solutions, contain only Green Roads products and no traditional sales items (“You can’t use the same dispenser you would use for a chocolate bar or a can of soda,” points out Sosin).

If any eyebrows are raised, vending machines are legal under federal law. In 2018, the US Farm Bill legalized hemp-based cannabinoids as long as their THC content – the compound that gets you high – remains virtually non-existent, at 0.01% or less.

So kids won’t get their hands on “marijuana” that way (yes, the machines ask customers to affirm they’re 18, but that’s hard to enforce). At the state level, all but three states have legalized CBD, although its use in food and drink may be restricted.

Otherwise, Green Roads is on solid ground legally, although it remains to be seen if there is a local pushback. “Our products are not intoxicating,” says Sosin, who says he has not received any complaints to date. “Our products range from sleep products [using the cannabinoid CBN], stress, muscle and joint pain, concentration and relaxation. And among these solutions there are capsules, gummies, creams and roll-ons, so a wide variety of products. Prices are as low as $2.99 for a trial size of a product, tend to hover below $40, says Sosin, but go up to $99).

Of course, seeing how a “CBD vending machine” is a new experience for mall-goers, Signifi incorporated technology for consumers to ask questions. Touchscreens and a visible phone number are present, as is an internal camera allowing the company to diagnose and timestamp what’s wrong with the machine if the products aren’t showing up.

Green Roads, created in 2013 by pharmacist Laura Fuentes, went public when it was bought by Canadian-based Valens Company for $40 million in 2021 as a US location. According to an August announcement, Valens is itself being acquired by SNDL, in an equity-based deal.

Clearly, CBD and some of the more than 100 other cannabinoids in the cannabis plant are considered good investments. Sosin, who says Green Roads is set to launch a “more robust gold formula” oil, acknowledges the potential appeal of vending machines for Green Roads’ CBD competitors.

Yet that appeal, he adds, is easy to understand, given their obvious selling point: immediacy. “To not have to wait for a shipment to arrive for an online order, but [instead] have this moment [result]is ideal, he says. “Because the product is there: we think it’s a great service for our customers.”

Since the start of the so-called “special military operation” in February, which is how the Kremlin defines its military invasion of Ukraine, these rivalries have escalated.

And Vladimir Potanin, the second richest man in Russia with a fortune of more than 17 billion dollars according to Forbes, arouses a lot of jealousy.

A different status

The now infamous oligarchs emerged amidst the chaos of the 1990s, with the end of communism.

They bought up dying public companies at a very low price. They financed the State, then in ruins, ensuring the survival of President Boris Yeltsin, and took advantage of it to enrich themselves while the country sank into misery.

Under Vladimir Putin’s Kremlin, and from 2000, they were quickly put back in order, subject to the new rules of power.

But Potanin had a different status.

“The only real oligarch in Russia is Vladimir Potanin. He built his fortune in the beginning thanks to his political ties which remain strong today, ”said the same source with a smile – a Russian billionaire who downplays ties with the Kremlin as well as the complicated relationship between the oligarchs and political power.

Rise as the USSR crumbles

The success of Potanin, a graduate of Mgimo, the institute of political science for diplomatic elites, dates back to the 1990s. It was then that the former member of the Communist Party and official at the Ministry of Foreign Trade took advantage of the fall of the USSR to start a business.

He was first a consultant for foreign investments and then for the privatization of hydrocarbons and other natural resources. Thirty years later, it is now benefiting from soaring commodity prices thanks to Nornickel (formerly Norilsk Nickel), the metals giant it bought during the major privatizations of the 1990s.

The only real oligarch in Russia is Vladimir Potanin.

Potanin was one of the architects of the “loans for equity” program. He received shares in the oil company Sidanco but also in Norilsk Nickel, which marked the beginning of his fortune.

Well-connected bankers and people around them loaned the declining Kremlin $1.8 billion in exchange for shares in the gems of Soviet industry as collateral. They all knew the loans would never be repaid. This is how Potanin acquired 38% of Norilsk Nickel for only 170 million dollars, while the group declared revenues of 3.3 billion dollars.

Kremlin loyalty

Boris Yeltsin then appointed him Deputy Prime Minister in 1996, but the businessman only stayed in government for seven months.

His political and business skills lasted longer: he sold 10% of Sidanco to BP for $571 million in 1997, when he had only paid the state $130 million for a 51% stake. the company a year earlier – another bargain. A true oligarch, Potanin has used his political connections and banking influence to acquire valuable assets at low prices since the 1990s.

Faithful to the Kremlin, the oligarch is careful not to get involved in politics and even refrains from talking about it. He hardly makes any allusion to geopolitical tensions.

“Western sanctions are bad not only for Russia but also for those who adopted them. As so often in our history, external pressures that feel unfair have only served to strengthen the country’s unity within. Hence the patriotism that is built around Vladimir Putin. I feel patriotic but open to criticism of our country,” Potanin said in a rare interview.

It was in 2017, the last interview he gave to the French daily The echoes. His words are still relevant in 2022. Five years ago, he did not hide his discomfort with the press, he even joked, “I usually drink mostly tea. But when I meet a journalist, I tend to drink coffee…”

Banking ambition

At Interros today, the atmosphere calls for champagne. Last trick of the business magnate: his holding company Interros bought Rosbank from the French bank Société Générale.

An “orderly and responsible” exit, according to Frédéric Oudéa, the boss of the French group, who, on the morning of February 24, when Russia was launching its “special operation”, decided to let go of its Russian subsidiary.

Oudéa and Potanin have known each other since the first French investment in the capital of Rosbank in 2006.

In recent weeks, they have exchanged messages in English even though the billionaire speaks French. A regular visitor to the French Riviera town of Antibes during the summer, Potanin was awarded the Legion of Honor in 2017 after donating 250 works of modern Russian art to the Center Pompidou in France.

The French group Societe Generale found itself with a heavy bill (more than 4 billion dollars swallowed up to take control of Rosbank, zero dividends and 3 billion dollars in losses), quite a gain for Potanin in the acquisition of the first foreign bank in Russia.

Observers are now wondering if he will become the new banking oligarch. A painful prospect for some, but promising for others. “It’s quite an art what Potanin did! Societe Generale lost millions of dollars by leaving, millions earned by Potanin,” smiles a Russian banker.

Full attention to high technology

Potanin is said to have broader banking ambitions, notably after taking over the shares of Oleg Tinkov – the iconoclastic FinTech leader opposed to the “crazy war” in Ukraine – in the Tinkoff bank, which should now drop the name of its founder.

But this boiling private sector calls for a recovery, with many contenders ranging from Alfa-Bank to Promsvyazbank via the high-tech group Yandex or the investment fund AFK Sistema. As a result, Potanin’s sudden rise to success as a banker looks like a carefully staged script.

“We had made a counter-proposal for the takeover of Rosbank. But we quickly realized that everything was already sealed with Potanin,” confides a businessman in Moscow.

In his only interview this year, granted to the Russian agency Interfax, Potanin certainly denied any greater banking ambitions: no new takeovers, no plans for a Rosbank-Tinkoff merger. “We do not anticipate any further acquisitions in the sector,” he said.

He says that all his attention is first and foremost focused on Russian high-tech companies. Taking advantage of the departure of Western players, Interros has just taken a stake in Reksosft, one of the main national software publishers. Further acquisitions are expected to follow as Interros has established a billion dollar fund dedicated to high-tech projects.

Pal to Putin

In Norilsk, a northern city 350 kilometers above the Arctic Circle, the snow doesn’t melt until July. Surrounded by ore mines, the inhabitants have long breathed a rotten atmosphere with sulfur dioxide from nickel and copper factories.

Around the mines, the tundra and sky have now returned to their natural colors. Potanin plans to reduce sulfur dioxide emissions by 45% by 2023 from 2015 levels. A $3.5 billion project using state-of-the-art technology.

But global warming finally caught up with Potanin. All of Norilsk is built on stilts to protect buildings and factories from permafrost and where the ground is perpetually frozen.

After the collapse of a reservoir at a thermal power station in June 2020, there was a leak of 20,000 tonnes of hydrocarbons, an accident caused by the melting ice.

This is one of the largest fuel spills in Arctic history according to Greenpeace.

Vladimir Putin declared a state of emergency, then called the oligarch.

A loyal man, Potanin paid out a record 146 billion rubles (nearly $2 billion) in compensation for environmental damage. A page is now turned between the two Vladimirs. Potanin knows how to maneuver perfectly in Putin’s Russia.

MINNEAPOLIS — A Minneapolis man has been charged in a federal criminal complaint with possessing automatic locks and using 3D printers to make automatic locks from his residence, U.S. Attorney Andrew M. Luger said. .
An automatic trigger is a device that turns a semi-automatic firearm into a fully automatic firearm and is considered a machine gun under federal law.
According to court documents, on August 31, law enforcement conducted a controlled delivery of a package containing 30 pieces of firearms to 25-year-old Aaron Malik Cato at his Minneapolis residence.
The package, which had been shipped from Taiwan and intercepted by Customs and Border Protection officers, contained enough parts to create 10 automatic sears. During the search of Cato’s home, pursuant to a warrant, law enforcement recovered seven firearms, including five handguns and two AR platform firearms. Three of the handguns were equipped with automatic triggers and appeared to be privately manufactured firearms (ghost weapons). Law enforcement also found inside Cato’s residence four 3D printers and several 3D printed automatic triggers.

Cato is charged in a criminal complaint with possession of machine guns. He made his initial appearance on September 7 in United States District Court before Magistrate Judge Tony N. Leung and was ordered to remain in custody pending further proceedings.

This case is the result of an investigation by Homeland Security Investigations, the Bureau of Alcohol, Tobacco, Firearms and Explosives, US Customs and Border Protection and the Minneapolis Police Department.

Assistant United States Attorney Allison K. Ethen is prosecuting the case.

The US Department of Justice reminds people that a complaint is just an allegation and the defendant is presumed innocent until proven guilty beyond a reasonable doubt by a court.
